    The Construction of a Tower for Wireless Antennas on Land Owned by National Grid
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering a joint petition of Niagara Mohawk Power Corporation d/b/a National Grid and SBA Towers II, LLC to construct a tower for wireless antennas on National Grid's Harris Road Substation Facility in the Town of Onondaga.
    Statutory authority:
    Public Service Law, section 70
    Subject:
    The construction of a tower for wireless antennas on land owned by National Grid.
    Purpose:
    To approve, reject or modify the petition to build a tower for wireless antennas in the Town of Onondaga.
    Substance of proposed rule:
    Niagara Mohawk Power Corporation, d/b/a National Grid (National Grid) and SBA Towers II, LLC (the Petitioners) have requested permission for the construction of a cell tower and related facilities on National Grid's Harris Road Substation Facility in the Town of Onondaga, New York, pursuant to Section 70 of the Public Service Law.
    Construction of the tower will comply with the terms set in the Commission's January 10, 2005 Order in Case 04-M-1078, which established a streamlined procedure for the construction of such facilities on utility property. The Commission may accept, reject or modify the Petitioner's proposal.
