PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition by Niagara Generation, LLC to allow up to ten percent glued wood within clean MRF fuel eligible for use as biomass fuel in the Renewable Portfolio Standard program.
Statutory authority:
Public Service Law, sections 4(1), 5(2) and 66(1)
Subject:
Eligibility of glued wood as a clean biomass feedstock in the Renewable Portfolio Standard program.
Purpose:
To include electric energy generation for the State's consumers from ten percent glued wood as a renewable resource.
Substance of proposed rule:
The Commission is considering whether to adopt, modify, or reject, in whole or in part, potential modifications to the Renewable Portfolio Standard (RPS) program related to the eligibility of up to ten percent (10%) glued wood recovered from Materials Recovery Facilities (MRF) in the RPS program. In particular, the Commission is considering the "Verified Petition of Niagara Generation, LLC for Rulemaking to Allow Up To Ten Percent Glued Wood within Clean MRF Fuel to be Eligible for Use as Biomass Fuel in the Renewable Portfolio Program" dated March 26, 2012. Should the Commission grant the petition, Niagara Generation, LLC also requests that the RPS Biomass Power Guide be revised to include the modifications (http://tinyurl.com/6mhcods).
