    Rates of National Fuel Gas Distribution Corporation
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering whether the rates of National Fuel Gas Distribution Corporation should be made temporary, subject to refund, if those rates are higher than necessary for the provision of safe and adequate service.
    Statutory authority:
    Public Service Law, sections 66, 72 and 114
    Subject:
    Rates of National Fuel Gas Distribution Corporation.
    Purpose:
    To make the rates of National Fuel Gas Distribution Corporation temporary, subject to refund, if they are found to be excessive.
    Public hearing(s) will be held at:
    10:00 a.m., May 22, 2013 at Department of Public Service, Three Empire State Plaza, 3rd Fl., Albany, NY.
    Interpreter Service:
    Interpreter services will be made available to hearing impaired persons, at no charge, upon written request submitted within reasonable time prior to the scheduled public hearing. The written request must be addressed to the agency representative designated in the paragraph below.
    Accessibility:
    All public hearings have been scheduled at places reasonably accessible to persons with a mobility impairment.
    Substance of proposed rule:
    By Order issued April 19, 2013, the Public Service Commission instituted a proceeding to determine whether the rates of National Fuel Gas Distribution Corporation should be made temporary, subject to refund, while the Commission investigates whether those rates are higher than necessary to permit the utility to provide safe and adequate service.
