Notice of Abandoned Property Received by the State Comptroller
Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. A list of the names and last known addresses of the entitled owners of this abandoned property is maintained by the office in accordance with Section 1401 of the Abandoned Property Law. Department of Agriculture and Markets
PRELIMINARY STATEMENT
Section 205.12 of Title One of the Official Compilation of Codes, Rules and Regulations of the State of New York ("1 NYCRR"), relating to the New York State Cabbage Research and Development Program ("Program"), provides that at least once during each six-year period the Program is in effect, the Commissioner shall conduct a referendum of eligible New York State cabbage growers to determine whether they approve the continuation of the Program. Continuation of the Program is Subject to the approval of not less than 50 percent of such growers voting in the referendum. Upon such approval, a new six-year period begins as of the first of July of the year following the date approval of continuation of the Program is certified.
FINDINGS AND CONCLUSIONS
Pursuant to a Notice of Referendum, dated March 14, 2012, a referendum of eligible New York State cabbage growers was conducted through May 1, 2012 inclusive, to determine whether such growers approve continuation of the Program. The results of the referendum have been duly recorded and verified as follows:

No ballots were declared ineligible.
CERTIFICATION
Upon the results of the referendum as set forth above, I hereby certify, pursuant to 1 NYCRR Section 205.12 and Agriculture and Markets Law Section 294(2), that the percentage of eligible New York State cabbage growers required to approve the continuation of the Cabbage Research and Development Program has been met, with 82.6 percent of such cabbage growers participating in the referendum voting in favor of continuation of the Program.
NOW, THEREFORE, upon the findings and conclusions herein, I determine that the Cabbage Research and Development Program (1 NYCRR Part 205) should be and hereby is continued pursuant and subject to Article 2 of the Agriculture and Markets Law and 1 NYCRR Section 205.12.

Office of Fire Prevention and Control
Pursuant to Section 176-b of the Town Law, the Office of Fire Prevention and Control hereby gives notice of the following:
Application for Waiver of the Limitation on Non-resident Members of Volunteer Fire Companies
An application for a waiver of the requirements of paragraph a of subdivision 7 of section 176-b of the Town Law, which limits the membership of volunteer fire companies to forty-five per centum of the actual membership of the fire company, has been submitted by the Calcium Fire Department, County of Jefferson.
Pursuant to section 176-b of the Town Law, the non-resident membership limit shall be waived provided that no adjacent fire department objects within sixty days of the publication of this notice.
Objections shall be made in writing, setting forth the reasons such waiver should not be granted, and shall be submitted to: Bryant D. Stevens, State Fire Administrator, Office of Fire Prevention and Control, 99 Washington Ave., Suite 500, Albany, NY 12210-2833
Objections must be received by the State Fire Administrator within sixty days of the date of publication of this notice.
In cases where an objection is properly filed, the State Fire Administrator shall have the authority to grant a waiver upon consideration of (1) the difficulty of the fire company or district in retaining and recruiting adequate personnel; (2) any alternative means available to the fire company or district to address such difficulties; and (3) the impact of the waiver on adjacent fire departments.

The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for long term care services to comply with existing State statute. The following significant changes are proposed:
Long Term Care Services
• Effective for rate periods on and after June 1, 2012, the Commissioner may reduce or eliminate the payment factor for return on or return of equity in the capital cost component of Medicaid rates of payment for services provided by residential health care facilities. The estimated annual net aggregate decrease in gross Medicaid expenditures attributable to this initiative for state fiscal year 2012/2013 is $32.6 million.
The public is invited to review and comment on this proposed state plan amendment. Copies of which will be available for public review on the Department's website at: http://www.health.ny.gov/regulations/state_plans/status.
In addition, copies of the proposed state plan amendments will be on file and available for public review in each local (county) social services district.

Public Notice for the Niagara Falls Underground Railroad Heritage Area Management Plan pursuant to Title G, Article 35.03 and 35.05 of the New York Parks Recreation and Historic Preservation Law.
The New York State Legislature established the Niagara Falls Underground Railroad Heritage Area in 2008 for the purpose of preserving and enhancing the historic and cultural resources of the Underground Railroad in Niagara Falls, Niagara County, New York. The Niagara Falls Underground Railroad Heritage Area Commission prepared a management plan to be utilized for planning, preservation and enhancement of the Heritage Area.
