    Petition for Reconsideration of the Order Authorizing Framework for Community Choice Aggregation Opt-Out Program
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering petitions requesting reconsideration of the April 21, 2016 Order Authorizing Framework for Community Choice Aggregation Opt—out Program in Case 14-M-0224 filed by the Joint Utilities on May 23, 2016.
    Statutory authority:
    Public Service Law, sections 5(1)(b), (2), 22, 53, 65(1), (2), (3), 66(2) and (5)
    Subject:
    Petition for reconsideration of the Order Authorizing Framework for Community Choice Aggregation Opt-out Program.
    Purpose:
    To determine appropriate rules for Community Choice Aggregation Programs.
    Substance of proposed rule:
    The Public Service Commission is considering a petition requesting rehearing or reconsideration of the April 21, 2016 Order Authorizing Framework for Community Choice Aggregation Opt-out Program in Case 14-M-0224 filed by Consolidated Edison Company of New York, Inc., Orange and Rockland Utilities, Inc., Central Hudson Gas & Electric Corporation, National Fuel Gas Distribution Corporation, The Brooklyn Union Gas Company d/b/a National Grid NY, KeySpan Gas East Corporation d/b/a National Grid, Niagara Mohawk Power Corporation d/b/a National Grid, New York State Electric & Gas Corporation and Rochester Gas and Electric Corporation (collectively, the Joint Utilities) on May 23, 2016. The petition seeks reconsideration/clarification regarding the Joint Utilities’ opportunity to comment on implementation plans, the provision of customer telephone numbers and customer participation in low-income programs. Upon conducting its evaluation of the petition, the Commission may reaffirm its initial decision or adhere to it with additional rationale in denying the petition, modify or reverse the decision in granting the petition in whole or in part, or take such other or further action as it deems necessary with respect to the petition. However, the Commission will limit its review to the issues raised by the above-referenced petition.
