    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering what action to take concerning a May 26, 2009 Petition for Rehearing filed by Consolidated Edison Company of New York, Inc.
    Statutory authority:
    Public Service Law, sections 4(1), 65(1), 66(1) and (12)
    Subject:
    Electric rates for Consolidated Edison Company of New York, Inc.
    Purpose:
    Consider a Petition for Rehearing filed by Consolidated Edison Company of New York, Inc.
    Substance of proposed rule:
    On April 24, 2009, the Commission issued an Order Setting Electric Rates for Consolidated Edison Company of New York, Inc. (the Company). In a petition for rehearing dated and filed May 26, 2009, the Company seeks rehearing regarding those aspects of the April 24, 2009 order concerning an austerity adjustment; 50/50 sharing of the costs of Directors and Officers Liability Insurance; Performance-Based Directors Compensation; the Company’s cost of common equity; an incremental productivity adjustment one percentage point greater than the Company's proposal; and the treatment of certain energy efficiency costs.
