    Cooperstown Cuisine Trail
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    This is a consensus rule making to amend Part 206 of Title 1 NYCRR.
    Statutory authority:
    Agriculture and Markets Law, section 284-a
    Subject:
    Cooperstown Cuisine Trail.
    Purpose:
    To amend the trail description to include two new producers.
    Text of proposed rule:
    1 NYCRR Section 206.1 is amended to read as follows:
    § 206.1 Cooperstown Cuisine Trail.
    The Cooperstown Cuisine Trail, promoted as the Cooperstown Beverage Trail, is hereby described as: beginning at exit 17 of Interstate 88, northerly on NY Route 28 to Cooperstown, (approximately 17.3 miles); westerly on NY Route 28/NY Route 80 to the junction of NY Route [28 and NY Route 80 west of Oaksville] 51; southerly on NY Route 51 to Garretsville (approximately [5.3] 19.7 miles) for an overall length of [22.6] 37 miles.

    Consensus Rule Making Determination
    This rule is proposed as a consensus rule, within the definition of that term in State Administration Procedure Act section 102(11) pursuant to the expectation that no person is likely to object to its adoption because it is non-controversial.
    Agriculture and Markets Law § 284-a (L. 2004, C. 248, amended L. 2008, C. 448) directs that the Department designate farm, apple and cuisine trails to promote greater agricultural marketing and promotional opportunities for agricultural producers located in the areas of such trails. The proposed adoption of the rule amending the Cooperstown Cuisine Trail implements that directive.
    In considering the proposed trail amendment, the Department consulted with the New York State Department of Transportation, the Advisory Council on Agriculture, the New York State Scenic Byways Advisory Board, and the New York State Farmers Direct Marketing Association. Both the Department of Transportation and Scenic Byways reviewed the proposed changes to the Cooperstown Cuisine Trail and recommend approval. The Department did not receive a response from the either the Advisory Council on Agriculture or the New York State Farmers Direct Marketing Association. Since these organizations and their constituents do not disapprove, no one is likely to object to the proposed amendment.
    Job Impact Statement
    The proposed amendment of 1 NYCRR Part 206 would modify the Cooperstown Cuisine Trail description. The rule would not have a substantial adverse impact on jobs and employment activities. The rule amends the Cuisine Trail designation and modifies the trail route, on a portion of State Route 28, to add two new producers and increase tourism and marketing opportunities for all of the participating producers located on or near the trail. The amendment will benefit agricultural producers and the local economy and may actually create jobs by attracting more patrons to area businesses.
