    System Benefit Charge Funds by the New York State Energy Research and Development Authority
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed action:
    The Public Service Commission is considering directing the New York State Energy Research and Development Authority to reallocate a portion of system benefit charge (SBC) funds to fund the study by one or more consultants of new and improved opportunities for energy efficiency in the State of New York under a contract entered into between the consultant and the Department of Public Service.
    Statutory authority:
    Public Service Law, sections 2, 5 and 66
    Subject:
    Reallocation of a portion of SBC funds to fund the study by one or more consultants of new and improved opportunities for energy efficiency in the State of New York under a contract entered into between the consultant and the Department of Public Service.
    Purpose:
    To consider whether the commission should authorize the reallocation of a portion of SBC funds to fund the study by one or more consultants of new and improved opportunities for energy efficiency in the State of New York under a contract entered into between the consultant and the Department of Public Service.
    Substance of proposed rule:
    The New York State Energy Research and Development Authority (NYSERDA) is the Public Service Commission's (Commission) third-party administrator for funding related to the System Benefits Charge program (SBC). The Commission is considering, on its own motion, directing the reallocation of uncommitted SBC funds to be set aside by NYSERDA for use by the Department of Public Service (Department) to contract with one or more consultants for the purpose of studying new and improved opportunities for energy efficiency in the State of New York.
    The Commission may approve, reject, or modify, in whole or in part, this proposal and it may also consider other related matters.
