PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
The commission, on June 20, 2007, adopted an order approving Consolidated Edison Company of New York, Inc.'s request to make various changes in the rates, charges, rules and regulations contained in its schedule for electric service P.S.C. No. 9.

Public Service Law, section 66(12)
Subject:
Rider U — Distribution Load Relief Program.
Purpose:
To approve the modified Rider U — Distribution Load Relief Program to enhance participation in the program.
Substance of final rule:
The Public Service Commission adopted an order approving, with modifications Consolidated Edison Company of New York, Inc.'s (Con Edison) tariff amendments on a temporary basis to modify Rider U — Distribution Load Relief Program, and directed Con Edison to file further revisions to become effective on ot less than one day's notice on July 1, 2007, on a temporary basis and to submit a report to the Commission by January 31, 2008, including a complete assessment of the effectiveness of the Rider U program changes ultimately adopted on increasing the level of customer (load) participation and any recommended tariff changes that it would propose for implementation prior to the summer 2008 capability period, subject to the terms and conditions of the order.
