    Waiver of the Individual Residential Unit Metering Requirements
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    On 6/17/10, the PSC adopted an order granting Batavia Special Needs Apartments, L.P., located at 549-555 East Main Street, Batavia, New York, a waiver of the individual residential unit metering requirements, conditioned on continued use of the facility.
    Statutory authority:
    Public Service Law, sections 2, 4, 65 and 66
    Subject:
    Waiver of the individual residential unit metering requirements.
    Purpose:
    To grant waiver of the individual residential unit metering requirements, conditioned on continued use of the facility.
    Substance of final rule:
    The Commission, on June 17, 2010, adopted an order granting Batavia Special Needs Apartments L.P., located at 549-555 East Main Street, Batavia, New York, a waiver of the individual residential unit metering requirements in Opinion No. 76-17, conditioned on continued use of the facility, subject to the terms and conditions set forth in the order.

    No changes.
