PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:

Proposed Action:

The Commission is considering a petition by Astoria Gas Turbine Power LLC for approval of financing and a lightened regulatory regime in connection with a 1,040 MW electric generating facility to replace an existing 600 MW facility in Long Island City, NY.

Purpose:

Consideration of approval of financing and a lightened regulatory regime for a 1,040 MW electric generating facility.

Substance of proposed rule:

The Public Service Commission (Commission) is considering a petition dated April 23, 2010, from Astoria Gas Turbine Power LLC, requesting approval of financing and a lightened regulatory regime in connection with a 1,040 MW electric generating facility that will replace an existing 600 MW facility located in Long Island City, New York. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
