    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
    Action taken:
    On 6/18/09, the PSC adopted an order approving modifications to the Energy Efficiency Portfolio Standard and System Benefits Charge (SBC) programs by authorizing NYSERDA to use SBC interest earnings to pay the costs of an Evaluation Consultant.
    Statutory authority:
    Public Service Law, sections 4(1), 5(2) and 66(1)
    Subject:
    To pay for a consultant on evaluation methods out of general SBC funds.
    Purpose:
    To authorize NYSERDA to use SBC interest earnings to pay the costs of an Evaluation Consultant.
    Substance of final rule:
    The Commission, on June 18, 2009, adopted an order approving the modifications to the Energy Efficiency Portfolio Standard and System Benefits Charge (SBC) programs by authorizing the New York State Energy Research and Development Authority (NYSERDA) to use SBC interest earnings to pay the costs of an Evaluation Consultant, subject to the terms and conditions set forth in the order.
