PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The Public Service Commission is considering whether to approve or reject in whole or in part, a petition by the Town of Torrey (Yates County), for a waiver of 16 NYCRR Part 894.1, 894.2, 894.3 and 894.4 pertaining to the franchising process.
Statutory authority:
Public Service Law, section 216(1)
Subject:
Waiver of 16 NYCRR sections 894.1, 894.2, 894.3 and 894.4.
Purpose:
To allow the Town of Torrey (Yates County) and Time Warner Cable to expedite the cable television franchising process.
Substance of proposed rule:
The Public Service Commission is considering whether to approve or reject, in whole or in part, a petition by the Town of Torrey (Yates County) for a waiver of Section 894.1 (cable television advisory committee), 894.2 (final report of advisory committee), 894.3 (requests for proposals) and 894.4 (invitation of applications; public notice of request for proposals) in order to expedite the cable television franchising process with Time Warner Cable.
