PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:

Proposed Action:

The PSC is considering whether to approve or reject, in whole or in part, a petition by the Town of Hamden (Delaware County) and Time Warner Entertainment—Advance/Newhouse Partnership to waive Sections 894.1-4 regarding franchising procedures.

Statutory authority:

Public Service Law, section 216(1)

Subject:

Waiver of 16 NYCRR 894.1 through 894.4.

Purpose:

To allow the Town of Hamden to waive certain preliminary franchising procedures to expedite the franchising process.

Substance of proposed rule:

The Public Service Commission is considering whether to approve, modify or reject the Petition of the Town of Hamden and Time Warner Entertainment-Advance/Newhouse Partnership to waive Sections 894.1, 894.2, 894.3, and 894.4 regarding franchising procedures for the Town of Hamden, Delaware County, New York.
