    Liability Insurance Covering All-Terrain Vehicles
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed action:
    This is a consensus rule making to amend Subpart 64-2 (Regulation 35-C) of Title 11 NYCRR.
    Statutory authority:
    Insurance Law, sections 201, 301 and 5103; and Vehicle and Traffic Law, section 2407
    Subject:
    Liability insurance covering all-terrain vehicles.
    Purpose:
    To clarify the reference to Regulation 68-A and the name of the endorsement referenced in section 64-2.1 of the rule.
    Text of proposed rule:
    The opening paragraph of Section 64-2.1 is amended to read as follows:
    Every ATV owner's policy of liability insurance issued or renewed in satisfaction of the minimum requirements of article VI of the Vehicle and Traffic Law and article 51 of the Insurance Law[,] shall [contain] set forth provisions providing minimum benefits at least equal to those set out below and contained in the provisions of the Mandatory Personal Injury Protection Endorsement — All-Terrain Vehicles in accordance with section 65-1.1(f) of Subpart 65-1 of this Title (Regulation 68-A).

    Consensus Rule Making Determination
    No person is likely to object to the rule because it merely clarifies the reference to Subpart 65-1 of this Title (Regulation 68-A) and the name of the endorsement referenced in section 64-2.1 of this Part.
    Job Impact Statement
    The proposed rule change will have no impact on jobs and employment opportunities in New York State because it merely clarifies references set forth in the existing provisions of the regulation.
