Attachment of Cingular's Wireless Facilities by Consolidated Edison Company of New York, Inc. and New Cingular Wireless PCS, LLC

PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:

Proposed action:

The commission is considering whether to approve or reject, in whole or in part, a joint petition filed by Consolidated Edison Company of New York, Inc. (Con Edison) and New Cingular Wireless PCS, LLC (Cingular) for approval under Public Services Law section 70 for Cingular to attach wireless telecommunications equipment to Con Edison's Transmission Facility, Tower K-226, Town of Mahopac, Putnam County, for approval of Con Edison's standard agreement for attachment of wireless facilities to its transmission towers, and for waiver of 16 NYCRR section 31.1(f), (g), (h), (j), (k) and (l).

Public Service Law, sections 4(1) and 70

Subject:

Attachment of Cingular's wireless facilities to Con Edison's transmission tower, standard agreement for such attachments and certain waivers.

Purpose:

To consider petition for attachment of wireless facilities to Con Edison's transmission tower, standard agreement and waivers.

Substance of proposed rule:

The Commission is considering whether to approve or reject, in whole or in part, a joint petition filed by Consolidated Edison Company of New York, Inc.
