PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The commission is investigating the failure of Niagara Mohawk Power Corporation d/b/a National Grid to achieve the system average interruption frequency index (SAIFI) service quality standard and considering the potential for doubling the penalties due as a result of such failure.
Statutory authority:
Public Service Law, section 66
Subject:
An investigation into the failure of National Grid to achieve the SAIFI measure of the Service Quality Assurance Program.
Purpose:
To investigate the failure of National Grid to achieve the SAIFI measure and determine the appropriateness of doubling the penalty for such failure.
Substance of proposed rule:
The Public Service Commission has instituted a proceeding to investigate the failure of Niagara Mohawk Power Corporation d/b/a National Grid to achieve the System Average Interruption Frequency Index (SAIFI) measure of the company's Service Quality Assurance Program. As part of that investigation the Commission will determine whether National Grid's performance warrants a doubling of the penalties set forth in the program.
