PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition filed by National Fuel Gas Distribution Corporation ("Distribution") for authorization to issue promissory notes up to $130,000,000.
Statutory authority:
Public Service Law, section 69
Subject:
Issuance of promissory notes for the period beginning January 1, 2012 through December 31, 2014.
Purpose:
To permit National Fuel Gas Distribution Corporation to issue promissory notes and to authorize the application of the proceeds.
Substance of proposed rule:
The Commission is considering whether to approve, reject or modify a petition by National Fuel Gas Distribution Corporation (Distribution) to issue promissory notes in the aggregate principal amount of not more than $130,000,000. Distribution will use net proceeds for various purposes; including reimbursement of Distribution's treasury for moneys expended for capital purposes during the calendar years 2012 through 2014, repayment of existing debt, construction expenditures, and for general corporate purposes. The Commission shall consider all other related matters.
