PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 6/14/12, the PSC adopted an order directing New York State Electric & Gas Corporation and Rochester Gas and Electric Corporation to remove the restriction on net metering of residential solar photovoltaic generation to “primary, legal” residences.
Statutory authority:
Public Service Law, section 66(j)
Subject:
Remove the restriction on net metering of residential solar photovoltaic generation.
Purpose:
To approve the removal of the restriction on net metering of residential solar photovoltaic generation.
Substance of final rule:
The Commission, on June 14, 2012 adopted an order directing New York State Electric & Gas Corporation and Rochester Gas and Electric Corporation to remove the restriction on net metering of residential solar photovoltaic generation to "primary, legal" residences from their tariffs by filing the necessary tariff revisions no later than June 27, 2012 to become effective on July 1, 2012, subject to the terms and conditions of the order.
