    Waiver of a Commission Policy on Test Years in Rate Cases
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering the petition of Corning Natural Gas Corporation for a waiver of the Commission's policy requiring a rate case be filed no more than 150 day after the end of the test year.
    Statutory authority:
    Public Service Law, sections 66, 89-c and 92
    Subject:
    Waiver of a Commission policy on test years in rate cases.
    Purpose:
    To consider the waiver of the Commission's 150 day requirement.
    Substance of proposed rule:
    The Public Service Commission is considering the petition of Corning Natural Gas Corporation (the Company) for a waiver of the Commission's policy in its Statement of Policy on Test Periods in Major Rate Proceedings, issued November 23, 1977, requiring that all major rate cases be filed no more than 150 days after the end of the utility’s test year. In a petition filed on May 25, 2016, the Company requested a waiver of the policy requirement for its impending rate filing, which the Company anticipates will be made within 180 days from the end of its test year. The Commission may adopt, reject or modify, in whole or in part, the relief proposed and may resolve related matters.
