    Federal Community Services Block Grant (CSBG) funds are awarded to grantees in all counties of New York State. Community action agencies, community-based organizations, and Indian tribes or tribal organizations receive CSBG funds to provide advocacy, outreach, services and programs for economically disadvantaged persons in their local communities.
    This hearing will focus on the New York State Department of State’s CSBG Management Plan for federal fiscal year 2010. The Management Plan may be obtained from the Department of State website at http://www.dos.state.ny.us/dcs/forms.htm, or by contacting:

    Persons wishing to present testimony at the public hearing on the FFY 2010 Management Plan for the Community Services Block Grant (CSBG) Program are requested to complete the Public Hearing Reply Form (found at http://www.dos.state.ny.us/dcs/news.htm) prior to July 23, 2009 and mail it to the above address or by e-mail to dos.sm.DCS@dos.state.ny.us. Written comments may be submitted until August 10, 2009.
    Oral testimony will be limited to 10 minutes. In preparing the order of witnesses, the Department of State will attempt to accommodate individual requests to speak at particular times in view of special circumstances. These requests should be made on the attached reply form or communicated to DOS staff as early as possible. In the absence of a request, witnesses will be scheduled in the order in which reply forms are postmarked.
    Five copies of any prepared testimony should be submitted at the hearing registration desk. DOS would appreciate advance receipt of prepared statements.
    In order to further publicize these hearings, please inform interested parties and organizations of the Department of State’s interest in hearing testimony from all sources.

    While not required, the Department of Health proposes the following clarifying amendment to the Title XIX (Medicaid) State Plan for non-institutional services to clarify existing provisions of the Ambulatory Patient Group (APG) methodology:
    Non-Institutional Services
    • The Department clarifies that for purposes of base rate calculations, Medicaid reimbursement paid to facilities for services under the APG reimbursement system includes payments for ancillary services.
    There is no estimated annual change to gross Medicaid expenditures attributable to this clarification.

    Pursuant to Public Health Law, Article 2, Title 5-A, Section 265-a., the Department of Health hereby gives notice of the following:
    Request for Information (RFI): Promoting Scientific Advancement in Stem Cells Through Consortia (FAU# 0904270847)
    Purpose:
    The purpose of this Request for Information (RFI) is to gather feedback from scientists, clinicians, and administrators who have experience working in multi-institutional research programs (hereafter referred to as "consortia"). The information gathered as a result of this RFI may be used to develop one or more Requests for Applications (RFAs) for the purpose of supporting consortia related to stem cell research and development of novel therapeutic applications.
    Background:
    In April 2007, legislation was enacted creating the Empire State Stem Cell Board (ESSCB) and authorizing the investment of $600 million in State funding over the next 11 years. The Empire State Stem Cell Board is authorized to provide grants for basic, applied, translational and other research designed to advance scientific discoveries in fields related to stem cell biology.
    New York State Stem Cell Science (NYSTEM) is a program of the New York State Department of Health, whose purpose is to administer stem cell research funding based on recommendations and advice from the Empire State Stem Cell Board. Information about the ESSCB and NYSTEM can be found at: http://stemcell.ny.gov
    Among the goals of the ESSCB is promotion of collaboration and communication among New York State institutions through creation of one or more consortia that would establish New York as an attractive location for stem cell research, development, and commercialization. In order to develop appropriate Requests for Applications (RFA), NYSTEM staff is gathering information about the structure and administration of consortia that help them function effectively. The data collected will be presented to the ESSCB and may inform drafting of subsequent RFAs.

    • Should consortia RFA be targeted to specific diseases with teams designed to move along the translational pipeline, or be open to any important problem in stem cell research and its applications? Briefly explain your response.
    • What are the most effective means to ensure that funded consortia promote exchange of ideas, data and resources among members? Briefly explain your response.
    • What role, if any, should NYSTEM play in facilitating the goals of consortia? Briefly explain your response.

    Department of State Notice of 60-Day Review for Town of Wilmington Draft Local Waterfront Revitalization Program
    PURSUANT to Article 42 of the New York State Executive Law and 19 NYCRR Part 601, the New York State Department of State (DOS) has received and accepted a Draft Local Waterfront Revitalization Program (LWRP) for the Town of Wilmington.
    To approve this LWRP, the Secretary of State must find that it is consistent with Article 42 of the Executive Law and that it does not conflict with existing state programs and policies. Since state agency actions must be consistent with an approved LWRP, Article 42 requires that the public and any potentially affected state agency be given the opportunity to comment on the proposed program.

    Involved is the expansion of an existing propane distribution center. The existing capacity is 270,000 gallons in three exterior tanks and the proposal is to double the capacity by adding three additional tanks. The issue deals with the required distance separation between the proposed tanks. The facility is located on a 157-acre site at 68 Maple Avenue, Town of Coeymans, Albany County, State of New York.
    2009-0317 Matter of Noah Adams, Bay State Elevator Co., 40 Pleasant St., Albany, NY 12207 for a variance concerning public safety issues including the code requirements for elevator construction and installation.
    Involved is change of occupancy of an existing building to a R-2 (multiple dwelling) occupancy, six stories + basement in height, of Type IB (fire resistive) construction, having a cumulative gross floor area of 63,000 square feet and the elevator that is proposed to be installed in the building. The petitioner is seeking relief from the code requirements dictating the minimum rope diameter, sheave and access pit requirements. The building is located at 17 Chapel Street, City of Albany, Albany County, State of New York.
    2009-0318 Matter of Barry J. Rings Sr., Facility Director, Albany Memorial Hospital, 600 Northern Blvd., Albany, NY 12204 for a variance concerning public safety issues including the maximum quantity of corrosive liquids that can be stored in a single control area.
    Involved is a proposal to increase the amount of Chlorine Dioxide solution stored within a hospital control area.
