    Notice of Abandoned Property Received by the State Comptroller

    The New York State Department of Health hereby gives notice of its intent to award funding in the amount of $46,050 to the University at Albany Foundation. Grant funds will be utilized to develop skills and provide experiences for inner-city youth that will foster healthy lifestyles and decrease risk behaviors associated with violence, teen pregnancy and STDs.

    PUBLIC NOTICE
    Power Authority of the State of New York
    Pursuant to the Section 1251 of the Energy Policy Act of 2005 (EPAct) [16 U.S.C. 2621 (2007)], the Trustees of the Power Authority of the State of New York (Authority) were required to consider adopting Fuel Sources, Fossil Fuel Generation Efficiency and Net Metering standards (“Standards”) as required by the federal Energy Policy Act of 2005 (“EPACT”). The EPAct, which modified the Public Utility Regulatory Policies Act of 1978, provided for public comment as part of the consideration of the appropriateness of the new standard for various customer categories.
    At their meeting of July 31, 2007, the Authority’s Trustees directed that public notice of the Authority’s consideration of the Standards be published in the New York State Register and that a public hearing be held at which customers and the public could make oral statements and/or submit written comments. A notice of public hearing was published in the Miscellaneous Notices/Hearings section of the State Register on April 9, 2008. A public hearing on the proposed standard was held on May 8, 2008, with the public comment period ending on May 12, 2008. No comments were filed.
    At their meeting of July 29, 2008, the Authority’s Trustees adopted the Standards in Section 1252 of EPAct to the extent that the Authority has already done so.

    PUBLIC NOTICE
    Department of State F-2008–0433 Date of Issuance- August 13, 2008
    The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
    The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
    In F-2008-0433 (entitled the “Bush Terminal Piers Open Space Project”), the New York City Economic Development Corporation is proposing the remediation of the former 17-acre waterfront landfill site for development into a City park along the Upper New York Bay between 43rd and 51st Streets in Sunset Park, Kings County, New York. The planned remediation includes site regrading and capping with clean soil cover, passive and active landfill gas management, tidal pond and wetland mitigation and enhancements, shoreline stabilization along the landfill edge, removal of deteriorated pier and sand fill, groundwater monitoring, and institutional controls (including environmental easements, site inspections/certifications, access controls and restrictions).
    Specifically, the applicant has applied to the U.S. Army Corps of Engineers for authorization for the following site remediation measures:
    • excavate sediments and fill along the landfill shoreline and place rip-rap along the landfill edges;
    • cleanup and partially fill and cap bottom sediments in two partially filled-in tidal ponds;
    • place a temporary dike at the edge of the outer pond shoreline to allow for dewatering, filling and capping of pond bottoms;
    • remove contaminated sediments along the pond shoreline and tidal wetlands area and replace with a clean soil cover, riprap and/or enhanced wetlands; and
    • remove deteriorated pier and associated sand fill as mitigation to offset open water filling activities which are necessary to prevent further erosion of landfill contaminants into navigable waters.
    Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, August 28, 2008.
