    Noble Allegany's Request for Lightened Regulation
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Public Service Commission is considering whether to approve or reject, in whole or in part, an application by Noble Allegany Windpark, LLC (Noble Allegany) for an order providing for lightened regulation as an electric corporation.
    Statutory authority:
    Public Service Law, sections 4(1), 66(1), 69, 70 and 110
    Subject:
    Noble Allegany's request for lightened regulation.
    Purpose:
    To consider Noble Allegany's request for lightened regulation as an electric corporation.
    Substance of proposed rule:
    In a petition filed July 8, 2008 Noble Allegany Windpark, LLC (Noble) seeks a Certificate of Public Convenience and Necessity to construct and operate a wind-power generating facility and related facilities in the Towns of Centreville and Rushford, Allegany County. In connection with this request for licensing, Noble requests lightened regulation as an electric corporation.
