    Interruptible Base Rate Priorities
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The Commission is considering a proposed tariff filing by Consolidated Edison Company of New York, Inc. (ConEd) to make various changes in the rates, charges, rules and regulations contained in its Schedule for Gas Service, PSC No. 9.
    Statutory authority:
    Public Service Law, section 66(12)
    Subject:
    Interruptible Base Rate Priorities.
    Purpose:
    To implement revisions to alter and clarify tariff provisions applicable to Interruptible Base Rate Priorities.
    Substance of proposed rule:
    The Commission is considering a proposal filed by Consolidated Edison Company of New York, Inc. (Con Ed) that it shall: (1) revise the criteria for eligibility for the rate categories within each Priority of service in order to clarify to whom they apply; (2) make the application of the percentage increase in rates and charges applicable to interruptible customers the same as for firm and off-peak firm customers; and (3) clarify the eligibility criteria for Priority D service. Currently there are three categories of Priority service which include the residential, non-residential, and non-residential exempt from Petroleum Business Tax (PBT). The purpose of modifying how the percentage increase in rates and charges is applied to interruptible customers is to make that treatment consistent with the proposed definitions of each category of service. Thus customers taking interruptible service will not be treated the same as customers taking firm or off-peak firm service. The Commission may apply aspects of its decision here to the requirements for tariffs of other utilities.
