PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On July 16, 2008, the Public Service Commission adopted an order approving the joint petition of Light Tower Fiber LLC and KeySpan Communications Corp. for the merger of membership interests and related transactions.

Public Service Law, section 108(1)
Subject:
Merger of two companies.
Purpose:
To approve merger of Light Tower Fiber LLC and KeySpan Communications Corp.
Substance of final rule:
The Commission, on July 16, 2008, adopted an order approving the joint petition of Light Tower Fiber LLC and KeySpan Communications Corp. for the merger and acquisition by Light Tower Fiber LLC of all the membership interests of KeySpan Communications Corp. and various ancillary transactions.
