PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On July 16, 2008, the PSC adopted an order regarding the petition of Niagara Mohawk Power Corporation for authorization to defer electric transmission and distribution investment costs.
Statutory authority:
Public Service Law, sections 65(1) and 66(1)
Subject:
Deferral of Capital Investment Plan expenditures.
Purpose:
To direct the company to supplement the record concerning its petition for deferral of certain capital investment expenditures.
Substance of final rule:
The Commission, on July 16, 2008, adopted an order directing Niagara Mohawk Power Corporation d/b/a National Grid to supplement the record concerning its request for deferral of certain 2008 electric transmission and distribution costs through a supplemental filing which includes a further demonstration and information consistent with the discussion contained in the order.
