    O&R's Electric Rate Plan
    PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
    Proposed Action:
    The PSC is considering a filing of Orange and Rockland Utilities, Inc. (O&R) seeking minor revision to the deferral limitation set forth in its Electric Rate Plan. The Commission may accept reject or modify in whole or in part the request.
    Statutory authority:
    Public Service Law, sections 4, 5, 65 and 66
    Subject:
    O&R's Electric Rate Plan.
    Purpose:
    Modification of the deferral limitation provision set forth in O&R's Electric Rate Plan.
    Substance of proposed rule:
    In accordance with the New York Public Service Commission's Order Establishing Electric Rate Plan for Orange and Rockland Utilities, Inc. issued June 14, 2012 in the above-referenced proceeding (Electric Rate Plan), Orange and Rockland Utilities, Inc. (O&R) filed with the Secretary on July 10, 2012, “agreed-upon” examples demonstrating the operation of the limitations on deferrals” provision of its Electric Rate Plan (July 10 filing). These examples were requested given the fact that the parties sought to better understand how the annual calculation of the deferral limitations provision would work with the cumulative calculation of the related earnings sharing mechanism. This filing was made by O&R on behalf of itself, Department of Public Service Staff and the Utility Intervention Unit of the Department of State. The July 10 filing states that the intent of the parties with respect to the calculation of the deferral limitation provision is not clearly reflected in the Electric Rate Plan and that the calculation of the deferral limitation should be done on a cumulative basis rather than an annual basis in order to better coordinate with the cumulative calculation of the earnings sharing mechanism. The Commission is considering whether to grant, deny or modify, in whole or in part, the July 10 request for modification of the Electric Rate Plan.
