Notice of Annulment of Dissolution of Certain Business Corporations

Federal Substance Abuse Prevention and Treatment Block Grant Application and Annual Synar Report
OASAS has developed an application for 2011 Federal fiscal year funding of the Substance Abuse Prevention and Treatment (SAPT) Block Grant. Comments from the public are invited during the period September 20, 2010 through September 24, 2010.
The application, which will be submitted by OASAS as required by the Federal government, includes assurances and certifications of compliance with Federal statute and regulations, prevention and treatment goals and objectives for OASAS and subrecipients funded with this grant and a description of the intended use of 2011-2013 Block Grant funds. The Synar Report details New York's efforts to limit tobacco sales to minors and completes New York's submission for the 2011 award.

Pursuant to 42 CFR Section 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for inpatient hospital, long-term care, and non-institutional services to comply with recently enacted statutory provisions. The following provides notification of new significant changes:
• Commencing September 16, 2010, all non-exempt payments shall be uniformly reduced by between 1.0 and 1.5 percent. Such reduction shall be applied, to the extent practicable, in equal amounts during the fiscal year. Such reduction shall continue through March 31, 2011.
• Payments exempt from the uniform reduction based on federal law prohibitions include, but are not limited to, the following:
- Federally Qualified Health Center services;
- Indian Health Services and services provided to Native Americans;
- Supplemental Medical Insurance - Part A and Part B;
- State Contribution for Prescription Drug Benefit (aka Medicare Part D payments);
- Any local share cap payment required by the Federal medical assistance percentage (FMAP) increase legislation;
- Required payments related to the School Supportive Health Services Program and Preschool Supportive Health Services Program settlement agreement;
- Services provided to American citizen repatriates.
• Payments exempt from the uniform reduction based on their being funded exclusively with federal and/or local funds include, but are not limited to, the following:
- Upper payment limit payments to non-state owned or operated governmental providers certified under Article 28 of the NYS Public Health Law;
- Certified public expenditure payments to the NYC Health and Hospital Corporation;
- Certain disproportionate share payments to non-state operated or owned governmental hospitals;
- Services provided to inmates of local correctional facilities.
• In addition, Medicaid administration costs paid to local governments, contractors and other such entities will also be reduced in the same manner as described above.
The estimated annual net aggregate decrease in gross Medicaid expenditures attributable to these proposed initiatives for state fiscal year 2010/2011 is up to $332 million dollars.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
In F-2010-0157, The Town of Clarkstown, proposes to construct a drainage improvement project in the hamlet of Central Nyack and is proposed to include upgrades to the existing storm drainage system as well as the construction of a 45 acre foot impoundment generally bounded by Schuyler Rd on the west, Vine street on the north, the Village of Nyack on the west and the Town of Clarkstown town line on the south. The 45 acre foot impoundment requires the construction of a 14 foot high earth dam and impacts approximately 3 acres of U.S. Army Corps of Engineers regulated wetlands which are proposed to be mitigated by the establishment of 3 acres of constructed wetlands.
The project is designed to retain stream flow, that drains approximately 198 acres of parkland, during a range of storm events and convey storm runoff from approximately 47.19 acres of residential area into the aforementioned stream, downstream of the proposed impoundment.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.

The United States Department of Interior's Fish and Wildlife Service, has determined that the proposed activity will be undertaken in a manner consistent to the maximum extent practicable with the enforceable policies of the New York State Coastal Management Program. The applicant's consistency determination and accompanying supporting information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
United States Department of Interior's Fish and Wildlife Service, through their Partners for Fish and Wildlife program, proposes to reopen historic channels, allowing current to pass through the wetland, and connect upland inlets with Delaney Bay. Approximately 60 acres of monotypic cattail marsh will be restored or enhanced to provide spawning/nursery habitat for northern pike and habitat for wetland dependent birds. All restoration will take place in the marsh area using an amphibious excavator equipped with a ditching head. The ditching head is capable of restoring channels to a width of up to four feet wide – by two feet deep. While on site, appropriate channel bends will be enhanced with shallow "oxbow" areas with an approximate width of six to eight feet wide – by one foot deep. These oxbows will encourage re-vegetation and diversity in wetland plants at the site. The site is between Middle and Rusho Bay Roads on Grindstone Island. The excavator will be refueled on the upland and spill containment pads will be utilized during refueling. Suny-ESF will monitor the site as part of their ongoing assessment of the Conservation Strategy for the St. Lawrence River. The work is proposed for the fall.

The United States Department of the Interior, Army Corps of Engineers - New York District (Corps) has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination, draft Environmental Assessment, and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2010-0796 (DA), the U.S. Army Corps of Engineers - New York District, is proposing work to expand the inlet dredging area at Mattituck Inlet within the Town of Southold, Suffolk County, New York. The proposed work would increase the existing channel footprint to -11 feet MLW in depth and would increase the channel width to obtain 90,000cy of material. An additional 10,000cy of material would be obtained from the updrift fillet within the public park know as Breakwater Beach. This 100,000cy of material for bypassing would be removed as a combined project under the Continuing Authority Program, Section 111 project and maintenance dredging under the Corps' Operation and Maintenance Program. Future bypassing would occur every 9-10 years as a combined Section 111 Project and as a maintenance dredging project. The Section 111 study supporting the selected project alternative was conducted under the Corps of Engineers' Continuing Authorities Program and was initiated based on a request from the New York State Department of Environmental Conservation (NYSDEC) concerned with erosion induced by the Federal Navigation Project at Mattituck Harbor, New York.
According to the information provided to the Department of State, the Corps has determined that the selected alternative is the best engineering solution and that implementation of the proposed Section 111 project will have significant beneficial impacts to the environment and surrounding communities including benefits to aquatic habitats and species, shorebird communities, improved downdrift shoreline stabilization and recreational opportunities, and reduced risk of storm damages due to the effects of the jetties.

The Department of State announces the availability for public review and comment of New York State's draft Section 309 Combined Assessment and Strategy for 2011 - 2015. The Combined Assessment and Strategy is a public document, prepared by the State's Coastal Management Program (CMP) for approval by the National Oceanic and Atmospheric Administration's Office of Ocean and Coastal Resource Management (OCRM) in order for the State to be eligible for federal Section 309 funding in FY2011-2015.
The document is presented in two parts: an assessment section which describes the current status and associated accomplishments by the State in each of nine federal ‘priority enhancement areas' (Wetlands, Coastal Hazards, Public Access, Marine Debris, Cumulative and Secondary Impacts, Special Area Management Planning, Ocean/Great Lakes Resources, Energy and Government Facility Siting, and Aquaculture); and a section which articulates the strategies the Department plans to pursue over the next five years using federal Section 309 funds to: update the State's Significant Coastal Fish and Wildlife Habitat program; establish a direct permit program within State designated Significant Coastal Fish and Wildlife Habitats; modify coastal policies to address marine debris, and develop related guidance for communities; develop ecosystem scale Local Waterfront Revitalization Programs (LWRPs); develop a NYS coastal management program amendment for Long Island's south shore estuary; and to develop a NYS coastal management program amendment for the Atlantic Ocean and Great Lakes.
